We want to offer our user's the highest quality experience at PADZ.com. The spirit of PADZ is as an open community web application where users are encouraged to submit and share information with other users. We promise to be honest, fair and reasonable with all of our users, but in return we ask that you do not abuse our trust and that you use PADZ.com in the spirit of a property rentals website and forum. In particular:

• We encourage posting of comments about properties, users and locations but please do not post information on the site which is inaccurate, malicious or offensive.
• Do not post photos or videos containing links to other websites within the image. These will be deleted without notice.
• Landlords and agents, please only post genuine properties on to the website. Properties which are posted but that do not exist or are simply links back to other websites will be deleted.
• Landlords and agents, please try to keep your property availability information accurate. This will encourage more people to view your property and will give you a greater likelihood of securing a tenant.
• Do not spam other users of this site with unsolicited messages.
• If you believe that any information on PADZ.com breaches these terms and conditions then please report the offending page to us either by clicking 'report!' or by emailing a link to the page to abuse@padz.com

1 Legal Information

1.1 The website PADZ.com is owned by PADZ Limited which is a UK registered company. All references to PADZ within these Terms & Conditions shall mean PADZ Limited and its parent companies, subsidiaries or related entities responsible for maintaining our web site and publications, and its directors, officers, employees and agents.

1.2 Your continued use of PADZ.com constitutes your acceptance of these Terms & Conditions and the other notices on PADZ.com. Should you object to any of the conditions in the notices on PADZ.com your sole option is to immediately cease your use of the web site.

1.3 Information on PADZ.com and in any PADZ publication should not be regarded as a substitute for professional legal, financial or real estate advice.

1.4 PADZ believes that all information provided on PADZ.com is accurate. However, no warranty is made as to the accuracy or reliability of the information contained therein and PADZ disclaim all liability and responsibility for any direct or indirect loss or damage which may be suffered by any recipient through relying on anything contained in or omitted from PADZ.com or our publications.

1.5 PADZ does not guarantee continuous, uninterrupted or secure access to our services, and operation of the PADZ.com website may be interfered with by numerous factors outside of our control. Subject to the foregoing, PADZ will not be liable for any economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, or any special, indirect or consequential damages (however arising, including negligence) arising out of or in connection with this User Agreement.

1.7 PADZ also has no liability of any sort (including liability for negligence) for the acts or omissions of other providers of telecommunications services or for faults in or failures of their networks and equipment.

1.8 Our liability to you or any third party, and the liability of our parent, subsidiaries, affiliates, officers, directors, agents and employees, in any circumstance is limited to the total fees you have paid to us in relation to the listing or other service offered giving rise to liability.

1.9 In the event that you have any right, claim or action against any other user arising from that user's use of the PADZ.com website, you agree to pursue such right, claim or action independently of and without recourse to us, and you release PADZ (and our parent, subsidiaries, affiliates, officers, directors, agents and employees) from all claims, liability, damages, losses, costs and expenses, including legal fees, known and unknown, arising from or in any way connected with such right, claim or action.

1.10 If any provision of these Terms & Conditions is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforceable. You agree that these Terms & Conditions and all incorporated agreements may be automatically assigned by PADZ, in our sole discretion, to a third party in the event of a merger or acquisition or any other event.

1.11 PADZ retains all right, title, and interest in and to the PADZ.com web application software, and any rights not granted to you herein are reserved by PADZ. You may not reverse engineer, disassemble, decompile, or translate the software, or otherwise attempt to derive the source code of the software, except to the extent allowed under any applicable law. If applicable law permits such activities, any information so discovered must be promptly disclosed to PADZ and shall be deemed to be the confidential proprietary information of PADZ.

2 User Accounts

2.1 PADZ reserves the right at their sole discretion to remove any user account and their associated properties and postings for any reason and without any compensation or repayment of fees.

2.2 Users who abuse the PADZ.com website through malicious activities, or by posting offensive remarks, photos or videos to the website will be removed from the site without notice.

2.3 Without limiting any other remedies, PADZ may suspend or terminate your account if we suspect that you have engaged or are about to engage in, or have been in any way involved in or linked to, fraudulent activity in connection with the PADZ.com website.

3 Property Listings

3.1 PADZ reserves the right at their sole discretion to remove any property listing from the website for any reason and without any compensation or repayment of fees.

3.2 Where property details are deliberately manipulated to achieve higher listings, such as by recording them as very low or zero cost, then PADZ reserves the right to remove these properties from listing on the PADZ.com website.

3.3 Where property details contain information which is not related to the rental of a specific property then PADZ reserves the right to remove these properties from being listed on the PADZ.com website.

4 Your Information

4.1 Information which you post on PADZ.com and your activities on our site must not:

• be false, inaccurate or misleading;
• be offensive or menacing, abusive, defamatory, or in breach of copyright, confidence, privacy or any other rights;
• infringe any third party's copyright, patent, trade mark, trade secret or other proprietary rights or rights of publicity or privacy;
• be fraudulent or involve counterfeit or stolen items;
• be in breach of any applicable laws or regulations (including, but not limited to, laws governing export control, consumer protection, unfair competition, anti-discrimination, false advertising);
• be obscene, indecent or contain child pornography;
• create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers;
• link directly or indirectly to or include descriptions of goods or services that are prohibited under these Terms & Conditions;
• contain any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority or expropriate any system, data or personal information;
• cause the PADZ.com website to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the PADZ.com website is in any way impaired.

4.2 You grant PADZ a non-exclusive, world-wide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) licence to exercise the copyright, trade mark, publicity, and database rights you have in your information posted to PADZ.com, in any media now known or not currently known. You also waive all moral rights you have in your information posted to PADZ.com to the fullest extent permitted by law.

4.3 By accepting these Terms and Conditions, you agree that, with respect to other users' personally identifiable information that you obtain through the PADZ.com website you may only use such information for a genuine PADZ-facilitated transaction or any other purpose that such user expressly agrees to.

5 Copyright

5.1 The subject matter on and accessible from the PADZ.com web site and publications is copyright. Apart from fair dealing permitted by the UK copyright legislation, PADZ grants visitors to the site permission to download copyright material only for private purposes. For reproduction or use of our copyright material beyond such use, written permission must be obtained directly from PADZ or the relevant copyright owner. 7 Jurisdiction

7.1 Your use of the PADZ.com web site and all of our legal notices will be governed by and construed in accordance with the laws of England and Wales, and by using our websites you irrevocably and unconditionally submit to the jurisdiction of the courts of England.
